Pitbull Twitter Racism After He Supports Racist Florida Governor

Twitter Racism Strikes Again Against Pitbull At The AMAs according to the Huffington Post, however, Chicano and Latino heads turned when Miami native Armando Christian Pérez, who most know as Pitbull, posted a photo with Gov. Rick Scott and gave the Florida Governor a shout out.

Chicanos and Latinos who do not benefit from Cuban amnesty are hell bent on reviving the Chicano movement — particularly when Cuban Republicans have done a decent bang up job on the great Hispanic and Latin experiment.  Cubans make up approximately 3% of the Latin population pie vs. Mexican American Chicanos who make up almost 70% of that same pie, yet we see some of these “Hispanics” such as Senator Ted Cruz and Senator Marco Rubio trying to capitalize in politics off of our population numbers. Both of these senators endorse strict Arizona-style anti-immigration laws even though their families have benefited from Cuban amnesty via the Cuban Adjustment Act.   Chicanos have no choice but to distinguish the difference between Republican endorsing simpletons who have embraced an anti-immigrant / anti-Mexican RNC platform.

While we do not think it is cool to see twitter racism against Pitbull — we also do not think it is cool for Pitbull to give shout outs to Republicans after the RNC adopted an anti-immigrant platform in 2012 that was essentially blessed by Kris Kobach himself.  Perhaps musicians who claim to help the Voto Latino banner ought to watch who they give Republcian shout outs to especially when the shout outs are contrary to 70% of the Latin population pie.

More importantly, it was Gov. Rick Scott who did the following:

Scott vetoed the driver license bill for immigrants.

Supports an anti-immigrant Arizona SB 1070 style law in Florida.

Latino Decisions: Chicanos / Latinos Overwhelmingly Support Obama’s Immigration Executive Action

Via Political Wire:

A new Latino Decisions poll finds 89% of Latino voters support President Obama’s decision to give temporary legal status to nearly five million undocumented immigrants.

Also interesting: 85% of independents and 76% of Latinos who identify as Republicans support Obama’s move.

Said pollster Matt Barreto: “This is the most unified we have seen Latino public opinion on any issue… The White House was smart to put this step to protect parents — almost nobody in the Latino community is going to say they don’t support a policy to keep parents and children together.”

Ruben Salazar: Why President Obama’s Immigration Executive Order Is A Big Deal

From a Chicano lawyer’s lens…

OBAMA’S EXECUTIVE ACTION IS A BIG DEAL, FOLKS – AND IT’S LEGAL TOO. SO, STAND IN LINE- IT’S FINALLY HERE!

In the aftermath of President Obama’s announcement on his executive action, some critics are minimizing the scope and effectiveness of the new immigration initiatives. Some people believe he did not go far enough, while others decry that it is unlawful action. Yet others express fear about registering, believing once they give their personal information they will be deported in the event the program is eliminated by the next president. But, these naysayers are either misinformed or overly pessimistic.

While this is not a panacea, and while no legal status or green card can be received, the scope of the new benefits of the immigration initiative cannot be underestimated. First of all, the infamous “Secured Communities” criminal program is eliminated and detainers discontinued , and under their new priorities immigration agents and officials will now look to deport only suspected terrorists, criminals ( 1 felony or 3 misdemeanors), and recent arrivals (after 1/1/2014). In addition, immigration lawyers will be combing their court files for people currently being deported and allow non-criminals administrative closure of their pending removal cases. This new “prioritization” and “PD” program will likely affect over 400,000 immigrants and directly reduce the current rate of 1,100 deportations per day, fulfilling a promise by Pres. Obama to focus only on criminal immigrants.

Moreover, two deferred action programs will be implemented very soon. The first one is an expansion of the current DACA (“Dreamer”) program for child arrivals put into place by Obama in 2012, resulting in work permits for more “Dreamers.” The age requirement will be eliminated, so people over 30 years of age may now apply. Also, it changed the date that continuous presence must have started from 2007 to 2010, so later arrivals now can apply. It also expanded temporary protection from deportation from only 2 years to 3 years. This new and improved DACA program is due to start in 90 days.

But, perhaps the boldest and biggest action is the creation of a new “deferred action” category for undocumented parents of US citizen or Legal Permanent Resident children of any age. This is the new “Deferred Action for Parents” (“DAP”) program. The only three conditions under DAP is that the immigrant have continuous presence in the United States for 5 years, have paid all their back taxes, and pass a criminal background checks similar to regular DACA applicants. Similar to DACA, the immigrant receives temporary protection from deportation for 3 years. This huge new program will help some 4.1 million immigrants. The new DAP program is due to start in 180 days.

Another major component is the expansion of the I-601A ”provisional waiver” program Obama put in place in 2013. Currently, only a spouse or parent of a US citizen may seek a pardon under section 601 and 601A. Before 2013, you must also leave the country to apply. This action builds upon and expands 601 waivers to include spouses and children of Legal Permanent Residents. Plus, the definition of “hardship” will be expanded and clarified. This expanded 601A waiver program should also help 10’s of thousands of immigrants who crossed the borders with no documents, and who need a 601 waiver of their 3 or 10 year bars to relief.

Accordingly, we should understand that this is no minor tweak of the immigration laws; it was a massive and bold initiative which will directly affect over 5 million hard-working, non-criminal immigrant youths and parents. And, Pres. Obama met his promise to the Latinos, big time!

For those who continue to believe the myth that the President’s actions are too broad or illegal, the law says otherwise. Executive action is clearly legal and constitutional under our 3-branch system of government. In fact, ever since we became a republic, American Presidents have issued Executive Orders. Indeed, every single President, except for one, has issued Executive Orders. George Washington correctly claimed he had the authority under Article II, Section 3 of the Constitution to issue executive orders. Some Presidents have used this executive branch authority much more than others. President Franklin Delano Roosevelt issued 3,522 Executive Orders, while William Henry Harrison issued zero, but it should be noted that Harrison died one month after being sworn in. And who thinks President Lincoln’s Emancipation Proclamation was a bad idea? That was an Executive Order, as well. Thus, under our Constitution, Presidents have wide discretion to determine how an existing federal law should be enforced. In fact, multiple Supreme Court opinions have upheld the President’s right to submit orders explaining how they will enforce existing laws. Immigration laws are not immune from those rulings. Multiple Presidents have issued executive orders on immigration, most notably President Ronald Reagan in 1987. That Republicans are so willing to accept President Reagan’s right to submit an executive order, but cry foul when it comes to President Obama, only shows this debate is more about politics than law. And, lest we have any doubt, the US Supreme Court has already said the President and immigration officials have “broad discretion”’ in enforcing immigration laws. In 2012, Justice Anthony Kennedy, in an opinion striking down Arizona’s anti-immigrant law, wrote the following:

“A principal feature of the removal system is the broad discretion exercised by immigration officials. Federal officials, as an initial matter, must decide whether it makes sense to pursue removal at all. If removal proceedings commence, aliens may seek asylum and other discretionary relief allowing them to remain in the country or at least to leave without formal removal.” ( Arizona v. United States)

When this is translated into layman’s terms—it means the US Supreme Court agrees that the President has broad authority to decide who should and shouldn’t be deported. Immigration is strictly a Federal issue and the Executive branch has the exclusive right to see the law be enforced in the best and most economical way it deems fit. That is why we have a President and why Presidents are able to submit orders explaining how they will enforce existing laws.

As to those who fear registration or of the effectiveness of the new DACA and DAP programs, we need only look to the highly successful 2012 DACA program, which has now been in place for over 2 years. The Pew Research Center estimated that up to 950,000 young immigrant youths are eligible to apply for DACA. Through March 31, 2014, 86% of 643,000 applications accepted have been approved, according to government data. So the vast majority of applicants get work permits. Some 77% (480,000) Mexicans have received work permits. The highest approval rate is in California, with 162,000 DACA recipients, compared to only 88,000 from Texas. The highest application rate is in Arizona, with some 66% of 34,000 eligible people have applied, according to the Migration Policy Institute. By all indications, then, the DACA program has been very successful to date. So, don’t worry, the new DACA and DAP programs should be just as successful. And, this new expansive 2014 DACA program could extend deportation relief to hundreds of thousands of immigrant youths.

Moreover, don’t be afraid Congress will take this program away. Due to the separation of powers clause in the US Constitution, Congress has no power to repeal what they call Obama’s new “immigration amnesty” program. Nor does Congress have the power to defund it, as it is wholly funded by the immigrants through the application and processing fees they pay.

And, yes, it is true that the next president may take the new programs away. But, I don’t think I’m going out on a limb by saying that, as a result of the blatant refusal of the Republican House of Representatives to take a simple up or down vote on the US Senate-approved Bill on comprehensive immigration reform, the Latino community will be soured and be driven to vote for more Democrats in 2016. I also don’t think it’s any news that popular Democrat, Hilary Clinton, will likely run for and win the next presidential election, and she may even be re-elected. And, I just don’t see President Clinton revoking these beneficial programs and alienating her Latino base. Thus, the new DACA and DAP programs will likely remain around for at least the next 9 years; which translates into 3 extensions of work permits.

So for all the naysayers, and the doubting Thomases, I say unto you – you are wrong, and you should be more positive and re-consider by applying or helping others apply as soon as possible. Stop being so pessimistic. The glass is half full! This is now a reality. Get informed, stand in line, and get on board and help families and friends to take advantage of this big deal! And, while you are at it, take time to thank our President for making good on his promise to Latinos, and for his bold show of leadership in helping fix our broken immigration system. Does Obama’s Immigration Executive Order of 2014 matter?

Obama’s Executive Order of 2014 does in fact matter to our communities and to the larger American community as a whole because it brings ‘out of the shadows’ over 4.5 million human beings into the light of day.  It will help elevate needless fear and gives back basic human dignity to those that pick our fruit and vegetables in the fields, prepare our meats in the meat packing houses, serve our fast food, coffee, lattes, clean our homes and hotel rooms, cook in our finest restaurants, build our homes, businesses, bridges and roads by authorizing their presence in this country and allowing them to work and pay taxes.

Moreover, bringing over 4.5 million undocumented people out of the shadows will refuel our U.S. economy to the tune of an estimated 0.4 to 0.9 percent over ten years, corresponding to increases in GDP of $90 billion to $210 billion in less than 10 years.  But most importantly, it will keep mixed-status families strong and together which is one of America’s core value, protecting family units.

This era is our opportunity for the Chicanos and Chicanas to reunite with the passion of the 60’s and register every eligible Mexican-American to vote.  Join me and show compassion to our immigrant community by becoming more politically astute.  This is our time to shine and organize to rise up together while flexing our political power…it is OUR TIME to take our rightful place in the Sun to protect our immigrant sisters and brothers by using our VOTE to make a difference in this country.

Arpaio Lawsuit Against Obama Really About Wanting Secure Communities Program And Continued Racial Profiling & Immigrant Women Domestic Violence Abuse

FOR IMMEDIATE RELEASE

Arizonans to Arpaio:  Lawsuit Against Obama Really About Wanting Secure Communities Program And Continued Racial Profiling and Immigrant Women Domestic Violence Abuse

Paola Eden Delagado Polanco was a young thriving girl and full of life, with charming simplicity and humility. She died October 29 at her 21 years as a victim of domestic violence  caused by her boyfriend in Bear, Delaware. Paola was six months pregnant, and by a miracle the baby survived
Phoenix, AZ –County Sheriff Joe Arpaio’s threat to filing a lawsuit claiming President Obama’s immigration executive action order is unconstitutional is a media theatrics move particularly when broad discretion” language was highlighted by Justice Anthony Kennedy who wrote the Court’s 5-3 opinion in Arizona v. United States, and joined by Chief Justice John Roberts.  Both Roberts and Kennedy are Republicans. Arpaio claims he will not waste taxpayer dollars, however, his new agenda appears to be a slap in the face to Judge Snow’s ruling that came with severe ‘racial profiling’ rebuke.   We believe Arpaio is still harboring anger when his 287(g) monies were taken away, and his reaction to Obama’s executive order is one that has more to do with more of his rogue law enforcement power being taken away.

We believe Arpaio is angry with Obama ending Secure Communities program that essentially spreads racial profiling concerns.  In fact, several law enforcement agencies have complained about the burden this places on them. Ending Secure Communities could have prevented immigrant deaths by women who were afraid to report domestic violence by their abusers for fear of being deported, and several law enforcement agencies have recognized the lack of trust they need from the community in order to hone in on the real criminal element of our society.
More importantly, Somos Independents would like to underscore a moment when Judge Snow ruled that Mr. Arpaio and his deputies had systematically profiled Latinos (most of which were of Mexican descent), targeting them for arrest during raids at day-laborer gathering spots and detaining them longer than other drivers during traffic stops. The subsequent order from the judge, who found that the sheriff’s office had violated the constitutional rights of Latinos, came with several requirements, including the appointment of a monitor to field complaints and oversee compliance.
Just as the  Department of Homeland Security (DHS) in December 2012 revoked Joe Arpaio’s Maricopa County Sheriff’s Office’s 287(g) task force agreement in response to allegations from the U.S. Department of Justice that the agency and Sheriff Joe Arpaio engaged in widespread racial profiling and civil rights violations against Mexican American Chicanos and Latinos, ending Secure Communities is a step in the right direction to decrease racial profiling against Chicano Mexican Americans and immigrant Latinos.
Arpaio prided himself during his 2012 campaign pretending to be sympathetic for women who are abused, when in reality he appears to be only sympathetic for those who are not persons of color.  As a former member of the law enforcement community, a reasonable person believes establishing trust between law enforcement and the community is a must post the Michael Brown Ferguson incident.  MCSO certainly has trust issues with Arizonans considering Arpaio has the blood of a United States Mexican-American Veteran on his hands, too.

Rest In Peace Ben Saiz

If there was a Chicano Hall of Fame, Ben Saiz would be a member of it.

Ben had come from ELA to CSUN in 1969 when there was a push to recruit Chicano students. Ben was from the mean streets of ELA. However he blossomed at CSUN and became a Chicano student leader. His spirit of activism never left him and he went on to stay active in the Ventura Co. community as a Youth Authority Parole Agent, Oxnard city councilman, and teacher.

Via Sergio Hernandez:

Just minutes ago we received terrible news that our dear friend Ben Saiz suddenly passed away this morning. Ben was an alumni of CSUN and the MeCha President during the early 70’s, He was a retired Parole Agent, Oxnard City councilman and Adjunct Professor at Oxnard City College. He was an avid collector of Chicano art and organized a show of his collection at Oxnard City College. This hits us deeply because Ben was one of our longtime friends…no details on his services but I will post when I receive notice.

Chicanas Blasts Ana Navarro after Obama’s #ImmigratioAction Move

What Chicanos Should Do After President Obama’s Immigration Action Move Last Night

Last night President Obama was the quarterback that threw Chicano Mexican-Americans the football with his #ImmigrationAction move.

What do Chicanos and Chicanas do now that momentum has been tossed to us?  Remember, we are the voters and so we have a responsibility to ensure just action is carried out for undocumented immigrants who cannot vote.

Do we take the ball 10 yards?  Or, do we keep our eyes on the chingon prize and attempt a touchdown?

I prefer the latter.

We knew that executive action would not include the entire 11 million but this is a very BIG beginning. It helps with the deportation problem the Republican Party allowed to get out of control even though the President gave them 6 damn years to fix it and do it the right way with regard to legal immigration reform.  In fact, the Democratic-controlled Senate passed immigration reform a year and a half ago and the Republicans did not do anything.  All they did was threaten the President with impeachment and lawsuits if he did anything with regard to immigration. President Obama decided to exercise his purview within his jurisdiction of our Constitution in time for the holidays.   His executive action does not include a pathway to citizenship because Congress has those powers, and the President is limited to his “executive” powers.  In my view, the President went as far as he could within the Constitution.

What was intended to do our community harm, our Creator intended it for good when “broad discretion” language was highlighted by Justice Anthony Kennedy who wrote the Court’s 5-3 opinion in Arizona v. United States, and joined by Chief Justice John Roberts.  Both Roberts and Kennedy are Republicans and President Obama merely exercised his executive power given to him by the law of the land — the United States Supreme Court.

Already we are seeing sell out Latina Republicans like Ana Navarro cry about President Obama’s Immigration Action on CNN last night, but make no mistake … not once did she tell the viewers how her own Republican Party via the House of Representatives who are controlled by the GOP do nothing, nada, zilch to advance the immigration reform bill that was passed by the Democratic-controlled Senate over one year ago.  Not once did she highlight how Speaker Boehner lied to the Mexican-American community that he was going to help fix the broken system but to no avail.  I implore main stream media and networks like CNN to take a “Hispanic or “Latino” from a hurting community that is largely affected.  It is a bonafide fact the community largely affected with regard to population numbers are those of Mexican descent.  The majority of those getting deported are Mexican — not Nicaraguan.   Indeed Ana Navarro is a member of the Nicaraguan community who has been at the forefront of Cuban issues where Cuban immigrants already enjoy Cuban amnesty — while ignoring Mexican issues.

Chicanos are taking our stand against the likes of Ana Navarro.  For far too long Chicanos entertained the great “Hispanic/Latino” experiment and all it has gotten us is backstabbing by people like herself, Sen. Marco Rubio who embraced SB 1070, Senator Ted Cruz who lied to Tejanos (saying he was for immigration reform) but once he got into Senate office he lied and said he did not support Senator John McCain’s “gang of 8” immigration reform views.   We have no choice but to revive the Chicano Movement and we will continue to remind Cuban-American Republicans (where Cuban American population account for 3% of the entire Latin population pie), and Nicaraguan-American Republicans like Ana Navarro (where Nicaraguan population account for 1% of the entire Latin population pie) that they do not speak for the approximate 70% of the Mexican American population.

Chicanos are Mexican American voters.  We ARE the epitome and bulk of the Latin population pie and we will be damned if we allow sellouts like Navarro to speak for the entire Latino population pie.  She is free to speak on behalf of Nicaraguan-Americans — but not us.

This is the time the Republican Party ought to re-evaluate their 2012 anti-immigrant RNC platform in order to contribute to a unique opportunity that will enable them to come up with solutions regarding the other half of the 11 million affected, but you won’t see Navarro talking about that will you?  We would like to remind Republicans the resistance of taxation without representation by the original Tea Party and ask they see the billions of dollars into our tax coffers from undocumented immigrants who pay into our state and federal tax system without representation.

So there you have it.  What are you going to do as a Chicana/o now that Obama passed us the football?

Momentum is with us now at this very moment.  The sky is the limit and let’s advance our football destiny forward because the destiny is in our control.  We can’t rely on Anglos, Cubanos, Nicaraguans y otros to decide for us …. let’s control our own destinies and do what we can to put that fire in our hearts again and advance ourselves forward.  This is our time, it’s our new era that began in 2012 told to us by old prophecies predicted by the Aztec calendar stone.
