Panel Connects Sheriff Joe Arpaio To Alleged Crime

There are times when Sheriff Joe Arpaio has seemed untouchable. In his nearly 20 years in office, he has survived political challenges, court judgments and criminal investigations.

But a ruling filed last week by an arm of the Arizona Supreme Court could prove to be a road map to the Republican lawman’s undoing.

A three-person disciplinary panel of the state’s high court said there was enough evidence to prove “beyond a reasonable doubt” that the sheriff and three of his closest allies participated in what the panel believes was federal crime in December 2009.

The alleged crime doesn’t stem from battles over immigration, pink underwear or any of the other things that have made Arpaio famous. Instead, it deals with a feud among local government officials in which the panel said the sheriff and his allies took things way too far.

The ruling was the result of almost two years of investigation by the State Bar of Arizona as well as two months of sworn testimony, including from Arpaio himself, in front of the Supreme Court’s disciplinary panel last year.

The panel looked at whether the two prosecutors, former Maricopa County Attorney Andrew Thomas and his aide Lisa Aubuchon, violated ethics rules as part of the feud with local government officials in the county. During the melee, Thomas and Arpaio launched criminal investigations into at least 14 people they were doing battle with, largely over budget issues.

Investigators with the US Justice Department appear to be focusing on the same feud as part of their ongoing criminal investigation into Arpaio’s office. The Arizona Republic reported on Sunday that FBI agents teamed up with state ethics investigators during the probe.

Through a spokesman, Arpaio declined on Tuesday to talk about the feud because some of it was also the subject of lawsuits.

Last week, the Supreme Court’s disciplinary panel decided unanimously that Thomas and Aubuchon had violated enough ethics rules that they should lose their law licenses. But the panelists also made it clear in their 247-page ruling that they believed the sheriff was very much at the center of the wrongdoing. Arpaio’s name appeared 48 times in the document.

Part of the ruling focused on a Dec. 8, 2009 meeting that involved the two prosecutors, the sheriff and his No. 2 man, Chief Deputy David Hendershott.

They were meeting to discuss what to do about Maricopa County Superior Court Judge Gary Donahoe, who was scheduled to hold a hearing the next day about whether the prosecutors should be allowed to continue investigating their fellow county officials. The foursome were afraid, according to the ruling, that Donahoe would rule against them.

During testimony before the panel, Arpaio’s longtime chief deputy said the sheriff was the one who first came up with the idea of charging the judge with a crime to force him off the case. The others agreed, Hendershott said. The next day, the prosecutors filed a criminal charges against the judge, accusing him of bribery, obstruction of justice and hindering a prosecution.

The prosecutors brought the charges “without a shred of evidence that Donahoe had committed any crime,” the ruling said. Starting on page 216, it revealed even more:

The evidence clearly and convincingly suggests that Mr. Thomas and Ms. Aubuchon, together with Chief Deputy Hendershott and Sheriff Arpaio, met on December 9, 2008, (sic) with the intention of stopping Judge Donahoe from issuing a ruling at a hearing scheduled the next day by filing criminal charges against him. That evidence is detailed in full throughout this opinion. Perhaps most telling, however, is the testimony of Sergeant Brandon Luth, who recounted Hendershott’s and Aubuchon’s reactions upon learning that the hearing had been vacated after the direct complaint against Judge Donahoe had been filed. Sgt. Luth testified that Aubuchon “looked pleased” when she mentioned to Sgt. Luth that the hearing had been cancelled. In addition, Sgt. Luth testified that when he handed the direct complaint to Mr. Hendershott and informed him that the hearing had been vacated, Mr. Hendershott uttered the word “checkmate.” This, together with all the evidence, clearly and convincingly suggests that Mr. Thomas and Ms. Aubuchon conspired to muzzle Judge Donahoe.

Were this a criminal case, we are confident that the evidence would establish this conspiracy beyond a reasonable doubt.

That plot, according to the panel, was a violation of federal law, specifically one that “makes it a crime to conspire to injure, oppress, threaten or intimidate any person in the free exercise or enjoyment of a right or privilege secured to him by the US Constitution.”

The judge clearly fell into that category, the panel’s ruling said.

The charges against Donahoe were later thrown out by another judge. Similarly, Arpaio’s investigations of the other 13 county officials he targeted also fell apart, often due to a lack of evidence or rulings that the alleged crimes had taken place so long ago that they were past the point when they could be charged.

The targets of the investigations included all five members of the county Board of Supervisors, three other judges, the county’s top two appointed officials, a high-ranking attorney for the county and two private lawyers.

Thomas charged two of the supervisors with crimes during the feud. Those charges were eventually tossed as well.

Thomas and Aubuchon have denied wrongdoing in the case. Thomas said last week he continues to be the victim of a witch hunt designed to allow corruption to continue in Maricopa County. Aubuchon appealed her disbarment this week and Thomas is expected to do the same soon.

Rubio initially stated he was against the DREAM Act, but now we are waiting to see his DREAM Act proposal. We are asking Rubio to to support the original DREAM Act — sponsored by Sen. Orrin Hatch (R-UT) sponsored version of S.1545 — the Development, Relief and Education for Alien Minors (DREAM) Act. We believe it is completely reasonable to ask Republicans to support the original DREAM Act sponsored by Republicans in 2001. Anything short of Hatch’s bill will be recognized as a divisive tactic and as a means to limit political power and issues supporting taxation without representation. According to Ron Hayduk, Professor of Political Science City University of New York (CUNY), immigrant taxation without representation not only challenges the legitimacy of America’s mantle of democratic governance but also provides a rationale and opportunity for organizing a progressive political majority.

Starting May 1, 2012, Lead Co-President and also a Civil Rights and immigration lawyer — Shirl Mora James, will begin a DREAM Act training video series that will keep DREAM Act activists and national Latino leaders UNITED and strong on this issue. The Tequila Party is fully aware of this issue becoming more and more politicized and the Mexican-American matriarchy will not allow our children and our youth to be taken advantage of anymore. We have already lost one of our own children — Joaquin Luna, when he took his own life because he felt he had no hope, and eligible Mexican-American voters in the Southwest will not allow his death to be in vain.

Lastly, if we do not see both Rubio obtaining solid commitments from GOP Senators from all high Hispanic populated states before the beginning of the 2012 autumn season (with Rubio taking the lead) we will consider their discussions of the DREAM Act mere lip service. Hispanicize 2012 Breaks New Ground: April Event Signals Bigger Vision with “Scarface” Screening, Miami Return and Dreams of a Latino Obama

What’s new for Hispanicize 2012, the annual event focused on Latino trends and trendsetters in social media, entertainment, marketing and media? For starters, the event has broadened in its third year to include Latino filmmakers and innovators—not just brands, media, marketers and bloggers relevant to the broader Hispanic community. To be held at the JW Marriott Marquis Hotel Miami, the event is being billed as a launch pad for creative endeavors, new products, technologies, marketing campaigns, films, and even books targeting Latinos.

If this sounds a bit like an SXSW-inspired turn for an event that premiered as a conference with a PR and blogging focus, that’s by design, assures founder Manny Ruiz: “First, we are not a conference anymore. That’s boring and drab. We are an event,” he says. “Second, I went to SXSW and came away inspired with a vision for a much wider event. It’s PR on steroids. We went way beyond simply increasing PR and social media sessions. This reflects the evolution of PR and blurring of the lines. Film, media, social media—it’s all a vehicle for communicating with this growing demographic. We’re rolling it all together.”

In addition, the event this year will also serve as the stage where important new media companies focused on Hispanics will be unveiled, as well as new ventures, adds Ruiz. “It’s all things Latino and is the iconic annual event for Latino trendsetters and newsmakers,” he says. “It’s the epitome of cool.”

How did last year’s Hispanicize event do? Did you meet your goals?

Every year, the event has evolved. In our first year, we were about trying to provide the marketing industry with the first Hispanic public relations and media event and making it client-driven versus talking to agencies. We accomplished that and set a great foundation for what is now Hispanicize 2012. We wanted to evolve that concept in the second year by adding a focus on social media, including lots of sessions for bloggers. It was fun having bloggers crash the party. That was the new recipe added to an already winning formula. Last year, we saw a 60% growth in attendance over the year before. And this year, we should see even greater growth.
How is this year’s Hispanicize different beyond what you already shared?

I was actually bitten by the SXSW bug hard last year and wanted to change our event then. But it was too late to adjust my content and speakers. So this year, we said we are basically the Hispanic SXSW and we’re taking it to Miami. We’re bringing the event here permanently, and we’re on the path to making it last more days.

Miami is one of the most progressive cities in the states for Latinos: It’s a hub of power, money, influence, business, etc. It’s a city that could become a model for the New America in terms of helping Latinos get to the next level. It’s a city of empowerment and hope, and we want that to inform this event.
Can you provide some data on the Hispanic market’s growth?

Sure, here are a few that may be useful for your readers:

According to the Census, “Hispanics Account for More Than Half of Nation’s Growth in Past Decade” http://bit.ly/tpc7XS

The 2010 Census counted 50.5 million Hispanics in the United States, making up 16.3% of the total population. http://bit.ly/tpc7XS

The nation’s Latino population, which was 35.3 million in 2000, grew 43% over the decade. The Hispanic population also accounted for most of the nation’s growth—56%—from 2000 to 2010. http://bit.ly/tpc7XS

Hispanics, who can be of any race, are the nation’s largest minority group. http://bit.ly/tpc7XS

The buying power of Hispanics exceeded $1 trillion in 2010. By 2015, Packaged Facts forecasts the buying power of the Latino population as a whole will reach $1.3 trillion. http://bit.ly/ekhlmF. According to the Selig Center for Economic Growth, the purchasing power of the Hispanic community is expected to exceed $1.3 trillion by 2013.

Hispanics are overall early adopters of technology/socials media. Latinos are more likely than whites to use Twitter (The Pew Research Center’s Internet & American Life Project). Hispanics have also taken-up Face Book faster than non-Latino whites at 54 vs. 43 percent (Big Research).

Perhaps nothing drives the point home better than a recently released study by 360i Report on Hispanic Digital Influencers. The importance of taping into Hispanics via social media has never been more significant. There are roughly 32.2 million US Hispanics online.

The number of Hispanics online is expected to increase to 42 million by 2015 (Interactive Advertising Bureau). In the past year alone, the number of Hispanics using social media grew by 38 percent versus 16 percent for the general population (comScore).

Why, in particular, have you added film to this? How is that relevant?

I did it for altruistic and ulterior motives alike. I see myself as a filmmaker right now (due to a documentary I’m making, among other projects). But beyond my interest, the real answer is that as we are very carefully adopting the concept of SXSW, we realize film is an exciting component of this program. The broader category beyond film is entertainment. And entertainment marketing is critical and crucial and engaging for bloggers, marketers, etc.—and it’s important to the Latino market, as well. Hispanicize is about spotlighting Latino innovators and trendsetters—and we can amplify those voices, whether they’re in music, film, marketing or whatever.

The way you get to the point of having a Latino Obama in the future is through influencing and impacting culture and magnifying the fact that the culture of Latinos is positive and good. I believe and hope that a hip-hop Latino present will emerge from Hispanicize 2012 and beyond for the future. You don’t get there by NOT expanding your vision. For this year’s conference, it’s film. In future years, it’ll be other things. I want people to think on the level of the Latin Grammies when they think about Hispanicize in the future.
What new tracks have you added that you want to mention here?

Here’s a quick snapshot:

1. Interactive (bloggers and social media): This track features more than 20 sessions exclusively devoted to best practices in social media and working with Latino bloggers. The event will continue to aggressively build on its legacy of bringing Hispanic bloggers together with the brands, agencies and companies that want to work with them. In addition to the blogger sessions, we’ll also feature best practice programs about leveraging Facebook, Twitter and other emerging tools to engage Latino communities online.

If you’re looking for a tip about working with Latinos in this space, it would be not to assume that everything that applies to non-Latinos about social media applies to Latinos.

2. Marketing/Advertising/Public Relations: This track will showcase the largest collection of cutting-edge campaigns from the past year in Hispanic public relations and advertising, the first time both disciplines have been spotlighted this in-depth at one time. Among the sessions will be award-winning case studies from the 2011 HPRA PRemio Awards.

One of the bright spots we’ll showcase is a program titled, “The Power of Musica: An Inside Look at BlackBerry’s Innovative Q’Viva Platform and What We Can Learn About Effectively Marketing to Latinos through Music.” This basically is about a program like “American Idol” for Latinos tied to the brand. It’s hugely successful and is not only cool, but also instructive to marketers and companies who want to reach Latinos.

3. Innovators: This exciting new track consists of a “Conversation With Innovators” series, which will feature A-list Latino celebrities, entrepreneurs and other famous inspiring achievers. This will be a Q&A with a celebrity journalist probing the minds of innovators. One of these will be 19-time Grammy winner Emilio Estefan, who also wrote “The Rhythm of Success: How an Immigrant Produced his Own American Dream.” We’ll be asking him about his discipline as an innovator—his habits of success. One thing he has talked about is that they don’t partner with people. They are very measured about who they tangle themselves with. Having had 19 business partners myself, I understand that line of thinking.

4. Entertainment: Hispanicize 2012 will leverage Miami’s wealth of Latino entertainers and media as well as the event’s ability to attract a Who’s Who of Latino bloggers to help premiere select films and music talent at Hispanicize 2012. Latino artists will also perform at the event’s popular after parties.

We’ll provide attendees with professional development sessions in entertainment, and give them a platform to go to any part of the event and learn show business marketing. We’re also showcasing Latino filmmakers in particular. For many Latinos, we may have the talent but not the resources to do a full film. But short films can be a building block. So we paid attention to this, as independent filmmaking is growing among Latinos. The first film we’ve accepted to spotlight here is called “The History of Space Flight.”

Singer El DeBarge Arrested On Drug Charges

The singer, who has long battled substance abuse issues, was arrested at 2 p.m. in the Los Angeles suburb for possession of narcotics with intent to sell, reports E! News and TMZ, the latter of which stated that LAPD officers observed DeBarge participating in an alleged drug deal near the 101 Freeway. Police confirmed to the outlets that he was booked and released on a $30,000 bail and is due in court on April 9.

This isn’t the R&B singer’s first run-in with the law. Since 2001, he’s been arrested three times for drug possession. In the mid-’80s, he was also arrested for domestic violence and vandalism. In 2008, he was sentenced to two years in prison for a drug bust. Back in 2008, he was sentenced to two years in prison for a drug bust.

Following his release, he attempted to get his music career back on track. In 2010, he released a well-reviewed album, titled “Second Chances,” which was nominated for two Grammys including Best Male R&B Vocal Performance and Best R&B Song. He had planned to go on tour in support of the record in 2011 but he checked into rehab and wound up canceling the tour.

El DeBarge comes from a musical family that includes three brothers, all of whom teamed to form the group DeBarge in the late 1970s. Their biggest R&B hits came courtesy of “Rhythm of the Night” and “Love Me in a Special Way.” His brother James was once married to Janet Jackson.

“We Are The One” is an album that consists of 11 tracks, including the politically charged title “The Enemy”, the love song “Don’t Let Me Down”, “The Only One”, “We Are The One”, “San Francisco”, “Free My Pain”, “Room To Breathe” , “Free My Pain”, “Don’t Let Me Down”, “Becky’s Song”, “Mended Heart” and the outspoken “It’s Time”, a track whose performance on the steps of City Hall during OccupyLA inspired a video by renowned filmmaker Leonardo Bondani, whose body of work includesMalditaVecindad, Tijuana No, Kid Frost, and El Vuh.

Check out the video “It’s Time” (Director’s Cut) a tribute to the world-wide movement inspired by Occupy Wall Street, that is continuously updated to include new footage as movement progresses.

Although the band was formerly a solo project for guitarist Sanders, this new record is true collaboration in which band members, Sanders, (vocalist) Quetzal Guerrero,and (bassist) David Filice,and (drummer) David Cowan contributed in a more creatively democratic process with the guidance of (producer) Chris Baseford, who’s worked with such heavy weights as Tommy Lee, John 5, and Rob Zombie, delivers the band’s diverse vision with a powerful driving punch that’s sure to keep listeners rocking and even dancing as they listen.

They also brought in session players Dave Schulz (Goo Goo Dolls, Berlin) on keys and well known and respected percussionists Chuck Prada(Sergio Mendes, Michael Jackson, Kelis) and Daniel de Los Reyes (Jennifer Lopez, Sting). The result is an honest portrayal of America today: A mosaic of love, strength, politics and its local repercussions, and the personal power to speak the truth and effect change starting with the individual.

“We really wanted to make music with substance that is relevant and inspirational to the listener,” says Quetzal Guerrero. The singer says that growing up as multicultural/multilingual American has always helped him understand and connect with different demographics of people.

“In our new album I believe we do exactly that, through our wide range of rhythms, styles and lyrics, One Tribe Nation attempts to find a common ground with everyone and connect with them on a musical level,” says the vocalist.

“For us, it’s not about blue, red, left or right, or any other device that’s used to keep us fighting amongst ourselves. It’s about those who build and those who destroy, and the reality is, we all choose a side in this battle by virtue of the decisions we make in our own lives each and every day,” says Michael Sanders, band-leader and guitarist.
